Delaware cottage food laws

Rules change, so always confirm with the official Delaware source.

The law: Delaware Cottage Food Regulation, 16 Delaware Administrative Code 4458A.

What you can sell

A limited range of approved shelf-stable foods made in residential kitchens; obtain product approval before selling.

What you can't sell

Foods requiring temperature control for safety and products outside the regulation’s approved scope.

Do you need a license or permit?

State registration/approval and training are required; the official application lists a $30 annual permit fee. May 2026 revisions affect permit procedures, whose complete current details could not be retrieved.

Sales limits

The gross annual sales cap was removed effective December 11, 2023.

Where you can sell

Confirm currently permitted venues, online ordering, shipping and interstate restrictions with DPH; these details were not fully verified.

Label requirements

The 2023 amendment replaces the owner’s name and full home address requirement with the establishment’s Delaware town/city and adds sesame to major allergens. Complete current label fields and exact disclaimer wording remain unverified.

Good to know

The official May 2026 final-rule URL returned HTTP 200, but the retrieved page did not expose the regulation text. Some details on this page could not be fully confirmed from official sources, so check with the state agency before you sell.

Pricing your products
