Kentucky cottage food laws

Rules change, so always confirm with the official Kentucky source.

The law: Home-Based Food Processors; KRS 217.136 and 902 KAR 45:090

What you can sell

Shelf-stable breads, fruit and pecan pies, cakes, cookies, candies, popcorn, high-acid fruit jams, preserves, fruit butters and listed dried foods are allowed.

What you can't sell

Temperature-controlled foods and foods outside the allowed list are excluded. Acidified products and low-acid canned foods are not allowed under this processor exemption.

Do you need a license or permit?

Agency guidance requires DFS-250 registration and a $50 fee, renewed annually with registration valid until March 31.

Sales limits

The current dollar threshold was not confirmed; do not rely on a commonly quoted cap without checking current KRS 217.015.

Where you can sell

Direct consumer sales from home, markets, roadside stands, community events and online are described in the regulation. Shipping and interstate rules were not confirmed.

Label requirements

Include operation name/address, food name, ingredients in descending weight, net quantity and processing date. KRS 217.136 specifies in 10-point type: “This product is home produced and processed”.

Good to know

The agency’s older labeling PDF hyphenates “home-produced”; the statute quoted here does not. The linked statute is official and returned 200. Some details on this page could not be fully confirmed from official sources, so check with the state agency before you sell.

Pricing your products

Knowing your real cost per item matters as much as following the law.
