Ohio cottage food laws

Rules change, so always confirm with the official Ohio source.

The law: Ohio Cottage Food Production Operation (ORC 3715; OAC 901:3-20)

What you can sell

Listed nonhazardous baked goods, jams, jellies, fruit butters, candy, granola, popcorn, dry mixes and other specifically authorized shelf-stable foods.

What you can't sell

Refrigerated baked goods and foods outside the authorized list are not cottage foods. Reduced-oxygen packaging is prohibited.

Do you need a license or permit?

Cottage food operations are exempt from licensing and routine inspection. Refrigerated baked goods require the separate home-bakery licensing pathway.

Sales limits

No cottage-food dollar cap was identified.

Where you can sell

Ohio retail stores and food-service operations may sell or use properly labeled cottage foods. Confirm internet, carrier shipping and interstate restrictions with ODA before selling that way.

Label requirements

Include business name/address, product name, ingredients in descending weight order, net weight/volume, and “This product is home produced.” in ten-point type. Declare applicable allergens.

Good to know

The agency cottage-food URL returned 404; the official labeling statute is supplied instead. Its curl request timed out in this environment. Some details on this page could not be fully confirmed from official sources, so check with the state agency before you sell.

Pricing your products

Knowing your real cost per item matters as much as following the law.
